In the summer of 2006 as part of our continuing effort to provide the public with free Illinois legal information we started presenting legal tips in our WGN radio. The following are some of the tips that we have presented. These tips are general information and shouldn't be construed as legal advice. - Did you know that the penalties for a DUI are higher when there is a child passenger in the car? If convicted, the offender would face mandatory jail time, mandatory community service and a minimum fine of $1,000.00.
- Did you know that if you were hired in Illinois, but are injured in another state or work in another state you can still file a claim for Illinois workers’ compensation benefits?
- Did you know despite the ads by lawyers that trying to make themselves appear unique by saying that they only get paid in your personal injury case if you win, the truth is that just about every lawyer works that way?
- Did you know that being paid a salary does not mean you are not eligible for overtime? Eligibility for overtime is based in part by the type of work you do, the amount of revenue the company has and the number of hours worked.
- Did you know that lawyers can be sued for malpractice as long as you show they committed irreparable harm that violated the standards required by attorneys?
- Did you know that adult social hosts who serve alcohol to minors can be liable for any death or injuries to persons or property that results?
- Did you know that all Illinois employers are required by law to carry workers’ compensation insurance? Non compliance with this rule is considered a threat to public safety and is now a felony.
- Did you know that in Illinois, employers of 100 or more employees are required to give 60 days of notice of plant closings or mass layoffs?
- Did you know that by transferring your assets into a living trust, you can minimize or eliminate estate taxes?
- Did you know that signing a consent form does not waive a patient’s rights to sue for medical malpractice?
- Did you know that the supporting parent in a divorce can be required by law to work in order to pay child support?
- Did you know that Illinois courts can suspend divorce cases for a one year period of reconciliation? During a period of reconciliation, all court orders from the divorce remain in effect, but enforcement of those orders is suspended.
- Did you know that those convicted of committing a domestic battery in the presence of a child must pay for that child’s counseling bills?
- Did you know that as of January 1, 2006, it is legal for parents to take children with them into voting booths?
- Did you know that nursing mothers can be excused from jury duty?
- Did you know that drunk driving offenders with 5 previous convictions are guilty of a Class X felony, punishable by 6-30 years in prison?
- Did you know that it is illegal to discriminate with respect to jobs and housing on the basis of sexual orientation?
- Did you know that people in jail awaiting trial cannot be denied the right to vote?
- Did you know that in 2008, all cigarettes sold in Illinois must be self-extinguishing?
- Did you know that under recently passed law, college students in Illinois will not be able to smoke in public or private college buildings?
- Did you know that a recent Illinois law is cracking down on persistent sex offenders? Those convicted of rape more than once will face life in prison without parole.
- Did you know that the Illinois Human Rights Act was amended to protect against discrimination based on sexual orientation and gender identity? Now it is illegal to discriminate on the basis of sexual orientation or gender identity with regard to employment, real estate or rental transactions, public accommodations and financial transactions.
- Did you know that as of this year, an individual can form a binding decision to donate tissue and organs upon death? Previously, a the decision to donate organs was made by a decedent’s family members.
- Did you know that in Illinois, there is a $500 fine for improperly using a disability card or license plate without the authorized holder present? In addition, fraudulent use of disability cards or license plates can result in the suspension of drivers’ licenses.
- Did you know that Illinois has become the first state to provide insurance coverage to children of all uninsured families, regardless of a family’s level of income?
- Did you know that if you are renting a house or apartment and it is sold that the new owner must honor the terms of your lease and can not increase your rent or force you to move until the lease expires?
- Did you know that since July of 2006, people with first aid training are protected from lawsuits by people that they tried to help in medical emergencies? Now "Good Samaritan" rescuers can only be sued for willful or careless misconduct.
